Il Santo Padre Francesco, nell’Udienza concessa a Sua Eccellenza Mons. Edgar Peña Parra, Sostituto per gli Affari Generali della Segreteria di Stato, il giorno 4 dicembre 2019, ha stabilito di emanare l’Istruzione Sulla riservatezza delle cause, allegata al presente Rescriptum e che ne forma parte integrante.

Il Santo Padre ha disposto che esso abbia fermo e stabile vigore, nonostante qualsiasi cosa contraria anche se degna di speciale menzione, che sia promulgato tramite pubblicazione su L’Osservatore Romano, entrando in vigore immediatamente, e quindi pubblicato nel commentario ufficiale degli Acta Apostolicae Sedis.

ISTRUZIONE

Sulla riservatezza delle cause

1. Non sono coperti dal segreto pontificio le denunce, i processi e le decisioni riguardanti i delitti di cui:

a) all’articolo 1 del Motu proprio “Vos estis lux mundi”, del 7 maggio 2019;

b) all’articolo 6 delle Normae de gravioribus delictis riservati al giudizio della Congregazione per la Dottrina della Fede, di cui al Motu proprio “Sacramentorum Sanctitatis Tutela”, di San Giovanni Paolo II, del 30 aprile 2001, e successive modifiche.

2. L’esclusione del segreto pontificio sussiste anche quando tali delitti siano stati commessi in concorso con altri delitti.

3. Nelle cause di cui al punto 1, le informazioni sono trattate in modo da garantirne la sicurezza, l’integrità e la riservatezza ai sensi dei canoni 471, 2° CIC e 244 §2, 2° CCEO, al fine di tutelare la buona fama, l’immagine e la sfera privata di tutte le persone coinvolte.

4. Il segreto d’ufficio non osta all’adempimento degli obblighi stabiliti in ogni luogo dalle leggi statali, compresi gli eventuali obblighi di segnalazione, nonché all’esecuzione delle richieste esecutive delle autorità giudiziarie civili.

5. A chi effettua la segnalazione, alla persona che afferma di essere stata offesa e ai testimoni non può essere imposto alcun vincolo di silenzio riguardo ai fatti di causa.

His Holiness Pope Francis, in the Audience granted to His Excellency Archbishop Edgar Peña Parra, Substitute for General Affairs of the Secretariat of State, on 4 December 2019, has decided to issue the Instruction On the Confidentiality of Legal Proceedings, attached to the present Rescriptum, of which it forms an integral part.

The Holy Father has determined that the Rescriptum shall have firm and stable application, notwithstanding anything to the contrary, even if worthy of special mention, that it shall be promulgated by publication in L’Osservatore Romano, with immediate force, and then be published in the official commentary Acta Apostolicae Sedis.

INSTRUCTION

On the Confidentiality of Legal Proceedings

1. The pontifical secret does not apply to accusations, trials and decisions involving the offences referred to in:

a) Article 1 of the Motu proprio “Vos estis lux mundi” (7 May 2019);

b) Article 6 of the Normae de gravioribus delictis reserved to the judgement of the Congregation for the Doctrine of the Faith, in accordance with the Motu proprioSacramentorum Sanctitatis Tutela” of Saint John Paul II (30 April 2001), and subsequent amendments.

2. Nor does the pontifical secret apply when such offenses were committed in conjunction with other offences.

3. In the cases referred to in No. 1, the information is to be treated in such a way as to ensure its security, integrity and confidentiality in accordance with the prescriptions of canons 471, 2° CIC and 244 §2, 2° CCEO, for the sake of protecting the good name, image and privacy of all persons involved.

4. Office confidentiality shall not prevent the fulfilment of the obligations laid down in all places by civil laws, including any reporting obligations, and the execution of enforceable requests of civil judicial authorities.

5. The person who files the report, the person who alleges to have been harmed and the witnesses shall not be bound by any obligation of silence with regard to matters involving the case.

Edgar Peña Parra, Sustituto para los Asuntos Generales de la Secretaría de Estado, el día 4 de diciembre de 2019, ha decidido emanar la Instrucción Sobre la confidencialidad de las causas, adjunta al presente Rescriptum y que forma parte integrante del mismo.

El Santo Padre ha dispuesto que este tenga vigencia firme y estable, no obstante cualquier disposición contraria, aunque sea digna de particular mención, que sea promulgado mediante la publicación en L’Osservatore Romano, entrando en vigor inmediatamente, y posteriormente publicado en el boletín oficial Acta Apostolicae Sedis.

INSTRUCCIÓN

Sobre la confidencialidad de las causas

1. No están sujetas al secreto pontificio las denuncias, los procesos y las decisiones concernientes a los delitos mencionados:

a) en el artículo 1 del Motu proprio “Vos estis lux mundi”, del 7 de mayo de 2019;

b) en el artículo 6 de las Normae de gravioribus delictis reservados al juicio de la Congregación para la Doctrina de la Fe, mencionados en el Motu proprio “Sacramentorum Sanctitatis Tutela”, de san Juan Pablo II, del 30 de abril de 2001, y sus posteriores modificaciones.

2. La exclusión del secreto pontificio también subsiste cuando tales delitos hayan sido cometidos en concomitancia con otros delitos.

3. En las causas a las que se refiere el punto 1, la información se tratará de manera que se garantice su seguridad, integridad y confidencialidad de acuerdo con los cánones 471, 2° del CIC y 244 § 2, 2° del CCEO, con el fin de proteger la buena reputación, la imagen y la privacidad de todas las personas involucradas.

4. El secreto de oficio no obsta para el cumplimiento de las obligaciones establecidas en cada lugar por la legislación estatal, incluidas las eventuales obligaciones de denuncia, así como dar curso a las resoluciones ejecutivas de las autoridades judiciales civiles.

5. No puede imponerse ningún vínculo de silencio con respecto a los hechos encausados ni al denunciante, ni a la persona que afirma haber sido perjudicada ni a los testigos.

Papst Franziskus hat in der dem Substituten für die Allgemeinen Angelegenheiten des Staatssekretariats Erzbischof Edgar Peña Parra am 4. Dezember 2019 gewährten Audienz festgelegt, die Instruktion über Die Vertraulichkeit der Fälle herauszugeben, die dem vorliegenden Rescriptum beigefügt ist und einen wesentlichen Bestandteil desselben bildet.

Der Heilige Vater hat verfügt, dass dieses fest und dauerhaft in Kraft tritt, ungeachtet jeder gegenteiligen Bestimmung, auch wenn sie besonderer Erwähnung würdig wäre, dass es durch Veröffentlichung in L’Osservatore Romano promulgiert wird und unmittelbar in Kraft tritt sowie dass es anschließend im Amtsblatt der Acta Apostolicae Sedis veröffentlicht wird.

Über die Vertraulichkeit der Fälle

1. Die Anzeigen, Prozesse und die Entscheidungen bezüglich der in den untenstehenden Artikeln aufgeführten Straftaten sind nicht durch das päpstliche Geheimnis gedeckt:

a) Artikel 1 des Motu proprio „Vos estis lux mundi“ vom 7. Mai 2019;

b) Artikel 6 der Normae de gravioribus delictis, die dem Urteil der Kongregation für die Glaubenslehre reserviert sind und im Motu proprio „Sacramentorum Sanctiatis Tutela“ vom heiligen Johannes Paul II. vom 30. April 2001 und den nachfolgenden Änderungen behandelt werden.

2. Der Ausschluss des päpstlichen Geheimnisses besteht auch, wenn diese Straftaten im Zusammentreffen mit anderen Delikten verübt worden sind.

3. In den unter Punkt 1 aufgeführten Fällen werden die Informationen unter Gewährleistung der Sicherheit, der Vollständigkeit und Vertraulichkeit gemäß can. 471, 2° CIC und can. 244 § 2, 2° CCEO behandelt, um den guten Ruf, das Ansehen und die Privatsphäre aller beteiligten Personen zu schützen.

4. Das Amtsgeheimnis steht der Erfüllung der allerorts von den staatlichen Gesetzen festgelegten Pflichten nicht im Wege, einschließlich allfälliger Mitteilungspflichten, wie auch der Ausführung von Verfügungen seitens der zivilen gerichtlichen Behörden.

5. Demjenigen, der Meldung erstattet, der Person, die aussagt, geschädigt worden zu sein und den Zeugen kann in keiner Weise eine Schweigepflicht hinsichtlich des Tatsachenbestandes auferlegt werden.
