Il Santo Padre Francesco, nell’Udienza concessa al sottoscritto Cardinale Segretario di Stato e al sottoscritto Cardinale Prefetto della Congregazione per Dottrina della Fede il giorno 4 ottobre 2019, ha stabilito di introdurre le seguenti modifiche alle “Normae de gravioribus delictis” riservati al giudizio della Congregazione per la Dottrina della Fede, di cui al Motu proprio “Sacramentorum Sanctitatis Tutela”, di San Giovanni Paolo II, del 30 aprile 2001, come modificate dal Rescriptum ex Audientia SS.mi, del 21 maggio 2010, a firma dell’allora Prefetto della Congregazione per la Dottrina della Fede, Card. William Levada:
Articolo 1
L’art. 6 § 1, 2° Sacramentorum Sanctitatis Tutela è integralmente sostituito dal seguente testo:
«l’acquisizione o la detenzione o la divulgazione, a fine di libidine, di immagini pornografiche di minori di diciotto anni da parte di un chierico, in qualunque modo e con qualunque strumento».
Articolo 2
§ 1 - L’art. 13 Sacramentorum Sanctitatis Tutela è integralmente sostituito dal seguente testo:
«Funge da Avvocato e Procuratore un fedele, provvisto di dottorato in diritto canonico, che viene approvato dal Presidente del collegio».
§ 2 - L’art. 14 Sacramentorum Sanctitatis Tutela è integralmente sostituito dal seguente testo:
«Negli altri Tribunali, poi, per le cause di cui nelle presenti norme, possono adempiere validamente gli uffici di Giudice, Promotore di Giustizia e Notaio soltanto sacerdoti».
Il Santo Padre ha disposto che il presente Rescriptum sia pubblicato su L’Osservatore Romano, nonché negli Acta Apostolicae Sedis, entrando in vigore a decorrere dal 1° gennaio 2020.

His Holiness Pope Francis, in the Audience granted to the undersigned Cardinal Secretary of State and the undersigned Cardinal Prefect of the Congregation for the Doctrine of the Faith on 4 October 2019, has decided to introduce the following amendments to the “Normae de gravioribus delictis” reserved to the judgement of the Congregation for the Doctrine of the Faith, in accordance with the Motu proprio of Saint John Paul II “Sacramentorum Sanctitatis Tutela” (30 April 2001), as amended by the Rescriptum ex Audientia SS.mi dated 21 May 2010 and signed by the then-Prefect of the Congregation for the Doctrine of the Faith, Cardinal William Levada:
Article 1
Art. 6 § 1, 2° Sacramentorum Sanctitatis Tutela is replaced in its entirety by the following text:
“The acquisition, possession or distribution by a cleric of pornographic images of minors under the age of eighteen, for purposes of sexual gratification, by whatever means or using whatever technology”.
Article 2
§ 1 – Art. 13 Sacramentorum Sanctitatis Tutela is replaced in its entirety by the following text:
“The role of Advocate or Procurator is carried out by a member of the faithful possessing a doctorate in canon law, who is approved by the presiding judge of the college”.
§ 2 – Art. 14 Sacramentorum Sanctitatis Tutela is replaced in its entirety by the following text:
“In other Tribunals, for the cases under these norms, only priests can validly carry out the functions of Judge, Promoter of Justice and Notary”.
The Holy Father has ordered that the present Rescriptum be published in L’Osservatore Romano and in Acta Apostolicae Sedis, and take effect on 1 January 2020.

El Santo Padre Francisco, en la Audiencia concedida al infrascrito Cardenal Secretario de Estado y al infrascrito Cardenal Prefecto de la Congregación para la Doctrina de la Fe, el 4 de octubre de 2019, ha decidido introducir los siguientes cambios en las “Normae de gravioribus delictis” reservados al juicio de la Congregación para la Doctrina de la Fe, a los que se refiere el Motu proprio “Sacramentorum Sanctitatis Tutela”, de San Juan Pablo II, del 30 de abril de 2001, tal como fueron enmendadas por el Rescriptum ex Audientia SS.mi, del 21 de mayo de 2010, firmado por el entonces Prefecto de la Congregación para la Doctrina de la Fe, el Cardenal William Levada:
Artículo 1

“Funge de abogado y procurador un fiel, doctorado en derecho canónico, aprobado por el presidente del colegio”.
§ 2° - El art. 14 del Sacramentorum Sanctitatis Tutela se sustituye en su totalidad por el texto siguiente:
“En los otros tribunales, sin embargo, para las causas de las que tratan las presentes normas, pueden desempeñar válidamente los oficios de juez, promotor de justicia y notario solamente sacerdotes”.

Papst Franziskus hat in der dem unterzeichnenden Kardinalsstaatssekretär und dem unterzeichnenden Kardinalpräfekten der Kongregation für die Glaubenslehre am 4. Oktober 2019 gewährten Audienz festgelegt, folgende Änderungen der „Normae de gravioribus delictis“, die dem Urteil der Kongregation für die Glaubenslehre reserviert sind, vorzunehmen, wie sie im Motu proprio „Sacramentorum Sanctitatis Tutela“ vom heiligen Johannes Paul II. vom 30. April 2001 aufgeführt sind und durch das vom damaligen Präfekten der Kongregation für die Glaubenslehre, Kardinal William Levada unterzeichnete Rescriptum ex Audientia Ss.mi vom 21. Mai 2010 verändert wurden.
Artikel 1
Art. 6 § 1, 2° Sacramentorum Sanctitatis Tutela wird vollständig durch den folgenden Text ersetzt:
„Der Erwerb, die Aufbewahrung und die Verbreitung pornographischer Bilder von Minderjährigen unter achtzehn Jahren in jedweder Form und mit jedwedem Mittel durch einen Kleriker in übler Absicht.“
Artikel 2
§ 1 - Art. 13 Sacramentorum Sanctitatis Tutela wird vollständig durch folgenden Text ersetzt:
„Als Anwalt und Prokurator fungiert ein Gläubiger, der ein Doktorat in Kirchenrecht besitzt und vom Vorsitzenden des Richterkollegiums approbiert wird.“
§ 2 – Art. 14 Sacramentorum Sanctitatis Tutela wird vollständig durch folgenden Text ersetzt:
„Auch bei den anderen Gerichten können für die in diesen Normen behandelten Fälle nur Priester die Ämter des Richters, Kirchenanwalts und Notars gültig ausüben.“
Der Heilige Vater hat verfügt, dass das vorliegende Rescriptum in L’Osservatore Romano wie auch in den Acta Apostolicae Sedis veröffentlicht wird und ab dem 1. Januar 2020 in Kraft tritt.
