The Holy See appreciates the attempts made in the Declaration on human rights, sexual orientation and gender identity –presented at the UN General Assembly on 18 December 2008- to condemn all forms of violence against homosexual persons as well as urge States to take necessary measures to put an end to all criminal penalties against them.

At the same time, the Holy See notes that the wording of this Declaration goes well beyond the abovementioned and shared intent.

In particular, the categories ‘sexual orientation’ and ‘gender identity’, used in the text, find no recognition or clear and agreed definition in international law. If they had to be taken into consideration in the proclaiming and implementing of fundamental rights, these would create serious uncertainty in the law as well as undermine the ability of States to enter into and enforce new and existing human rights conventions and standards.

Despite the Declaration’s rightful condemnation of and protection from all forms of violence against homosexual persons, the document, when considered in its entirety, goes beyond this goal and instead gives rise to uncertainty in the law and challenges existing human rights norms.

The Holy See continues to advocate that every sign of unjust discrimination towards homosexual persons should be avoided and urges States to do away with criminal penalties against them.

La Santa Sede apprezza gli sforzi fatti nella "Declaration on human rights, sexual orientation and gender identity" – presentata all’Assemblea Generale delle Nazioni Unite il 18 Dicembre 2008 - per condannare ogni forma di violenza nei confronti di persone omosessuali, come pure per spingere gli Stati a prendere tutte le misure necessarie per metter fine a tutte le pene criminali contro di esse.

Allo stesso tempo, la Santa Sede osserva che la formulazione di questa Dichiarazione va ben aldilà dell’intento sopra indicato e da essa condiviso.

In particolare, le categorie "orientamento sessuale" e "identità di genere", usate nel testo, non trovano riconoscimento o chiara e condivisa definizione nella legislazione internazionale. Se esse dovessero essere prese in considerazione nella proclamazione e nella traduzione in pratica di diritti fondamentali, sarebbero causa di una seria incertezza giuridica, come pure verrebbero a minare la capacità degli Stati alla partecipazione a e alla messa in atto di nuove o già esistenti convenzioni e standard sui diritti umani.

Nonostante che la Dichiarazione giustamente condanni tutte le forme di violenza contro le persone omosessuali e affermi il dovere di proteggerle da esse, il documento, considerato nella sua interezza, va aldilà di questo obiettivo e dà invece origine a incertezza delle leggi e mette in questione le norme esistenti sui diritti umani.

La Santa Sede continua a sostenere che ogni segno di ingiusta discriminazione nei confronti delle persone omosessuali dev’essere evitato, e spinge gli Stati a metter fine alle pene criminali contro di esse.
